CobbleStone may ask for some personal information when you register for product information and/or create an account, including your contact information. When using our products you may be asked to create a user account, which is used to protect your account from unauthorized access. An account allows you to access many of our services that require registration. When you use Contract Insight™ to manage your contracts, it maintains your contracts, contact lists, and other data related to your account in order to provide the service to you. When you use Contract Insight™, CobbleStone's servers automatically record and store certain information about your use.
Similar to other web services, the servers record information such as account activity (including storage usage, number of log-ins), data displayed, page visits and other information (including browser type, IP-address, date and time of access, cookie ID, and referrer URL).
CobbleStone maintains and processes your account information and its contents to provide the Contract Insight™, service to you and to improve our services. When providing your contact data related to requesting information about CobbleStone products and services, CobbleStone may send you information related to your account or other CobbleStone services.
CobbleStone does not sell, rent, or otherwise share your personal information with any third parties except in the limited circumstances, such as to process user activities, communicate with you directly (or indirectly through partners) about our products and services, or as required by laws or regulations. CobbleStone may use the data for internal use, marketing purposes, analysis, and to contact you.
CobbleStone complies with applicable data protection law, including Privacy Shield Principles for all onward transfers of Personal Information, including the onward transfer liability provisions in the Privacy Shield Principles.
In the event of a breach or unintended disclosure, CobbleStone will first attempt to isolate and mitigate the issue and notify affected users as reasonably possible.
CobbleStone Software participates in compliance with both the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information transferred from the European Union (“EU”), European Economic Area (“EEA”), and Switzerland to the United States, respectively. CobbleStone is committed to comply to applicable Privacy Shield principles in regard to all personal data received from the EU and/or Switzerland.
CobbleStone complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom, and Switzerland to the United States in reliance on Privacy Shield. CobbleStone has certified that it adheres to the Privacy Shield Principles with respect to such data. If there is any conflict between the policies in this privacy policy and data subject rights under the Privacy Shield Principles, the Privacy Shield Principles shall govern. With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, CobbleStone is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission.
Pursuant to the Privacy Shield Frameworks, EU, UK, and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States under Privacy Shield, should direct their query to legal@cobblestonesoftware.com. If requested to remove data, we will respond within a reasonable timeframe.
We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to legal@cobblestonesoftware.com.
In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
CobbleStone’s accountability for personal data that it receives in the United States under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, CobbleStone remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process personal data on its behalf do so in a manner inconsistent with the Principles, unless CobbleStone proves that it is not responsible for the event giving rise to the damage.
In compliance with the Privacy Shield Principles, CobbleStone commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to Privacy Shield. CobbleStone has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD. If your Privacy Shield complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. Update: It is recognized that the EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield are no longer valid transfer mechanisms for personal information from the European Union and its Member States, the European Economic Area, or Switzerland. The U.S. Department of Commerce, which oversees compliance with Privacy Shield has stated that it will nonetheless continue to administer the Privacy Shield program and that participants are not relieved of their obligations under Privacy Shield. Accordingly, CobbleStone, as a participant in the Privacy Shield program, will continue to comply with its commitments under the Privacy Shield as applicable.
CobbleStone may transfer personal user behavior information outside the countries where we and our clients are located. This includes transfers to countries outside the European Economic Area (“EEA”) and to countries that may not have laws that provide the same degree of protection for personal user behavior information as your home country. In accordance with applicable legal requirements, we take appropriate measures to facilitate adequate protection for any information so transferred.
Where we transfer personal user behavior information outside of the EEA to a country or framework not determined by the European Commission as providing an adequate level of protection for personal information, the transfers will have protective measures, such as standard contractual clauses. Our website generates server log files automatically. These log files are used to generate statistical information and error reports to ensure the website runs with minimum disruption and for security purposes. They may actively be used to identify individual visitors.
